Privacy Policy & Complaints Procedure – U Wealth SA

1. Introduction

U Wealth SA (hereinafter referred to as "U Wealth", "we", or "us") is a Swiss wealth management company based in Geneva, regulated by the Swiss Financial Market Supervisory Authority (FINMA) and supervised by an authorized supervisory organization (SO), AOOS, under the Swiss Financial Institutions Act (FinIA).


The protection of your personal data is essential to us. This Privacy Policy outlines how we collect, process, protect and use your data, and includes our complaints handling procedure. It applies to all interactions with us, both online and offline.

 

2. Complaints Procedure

U Wealth takes every complaint seriously and is committed to addressing it in a timely, clear, and transparent manner.

 

2.1 How to file a complaint

Our team is available Monday to Friday, from 8:30 AM to 6:00 PM.

2.2 Handling process

  1. You will receive an acknowledgment of receipt within 5 business days

  2. We aim to provide a full response within 4 weeks

  3. If a resolution cannot be provided within that time, we will inform you of the reason and provide a revised timeline

  4. If more than 8 weeks are required, you will receive a written explanation and, if appropriate, further action options

 

2.3 Contesting our decision

You have 3 months from the date of our final response to submit any additional information or request a review. If we do not hear from you during this time, the case will be considered closed.

 

3. Personal Data – Privacy Policy

3.1 Definitions

  2. Data subject: Any individual whose personal data is processed (clients, prospects, employees, representatives, etc.)

  1. U Wealth and affiliates (Unigestion Holding One and group)

  2. IT and compliance service providers

  3. Regulatory, judicial and tax authorities

  4. Third Party Service providers (lawyers, auditors, custodians, etc.)

  5. Any third parties with your prior consent or where required by law

 

3.7 International data transfers

Your data may be transferred outside of Switzerland. In such cases, we ensure adequate protection via:

  1. Swiss-approved Standard Contractual Clauses (SCCs)

  2. Risk assessments and appropriate safeguards

  3. Host countries with data protection deemed adequate by the Swiss Federal Data Protection and Information Commissioner (FDPIC)

 

3.8 Data security

We implement technical and organizational measures to:

  1. Prevent unauthorized access, alteration, or loss

  2. Ensure access is granted only to authorized personnel

  3. Monitor and respond to data breaches in accordance with applicable laws

 

3.9 Data retention

Your personal data is retained:

  1. For as long as the contractual relationship lasts

  2. And for up to 10 years after termination, unless longer retention is required by law

  3. Or as needed to defend legal claims or comply with investigation requests

To exercise your rights, please contact us in writing by post at the address provided in section 2.1.
We may ask for proof of identity. Excessive requests may incur a fee (up to CHF 300).
We aim to respond within 3 months. If more time is needed, you will be informed accordingly.

3.12 Data transmission and hosting

Our servers are hosted in Switzerland. By submitting data from outside Switzerland, you consent to its transfer and processing under Swiss law.
Please note that transmission over open networks (e.g., the internet or email) is not entirely secure. While we do our best to protect your data, U Wealth cannot guarantee its safety during transit. You may use alternative methods (e.g., registered mail) to send us sensitive information.

3.13 Applicable law and jurisdiction

This Privacy Policy is governed by substantive Swiss law, excluding its conflict of law provisions.
Any dispute arising from or relating to this policy shall be subject to the exclusive jurisdiction of the courts of the Canton of Geneva, without prejudice to any right of appeal to the Swiss Federal Supreme Court.
